Service terms

What you agree to when you pay for digital signage, a website, hosting, maintenance, or design work from Evident Business Solutions.

Who these terms cover

These terms apply to digital signage licences, websites and landing pages, website hosting and maintenance, and design services (such as menu design) that you order from Evident Business Solutions ("EBS"), 401 Downey Ave, Modesto, CA 95354. They sit alongside our terms of use and any written agreement you sign with us; if a signed agreement says something different, the signed agreement wins.

You agree to these terms by ticking the box at checkout in your EBS dashboard. We keep a record of that agreement: the date and time, the account you were signed in with, the IP address and browser you used, and the version of these terms.

Payment and your card on file

At checkout you see what is charged today and every amount charged after that, with dates. By paying, you authorize EBS to charge the card you enter, and to keep it on file with our payment processor to charge those amounts as they come due. Card numbers are entered on our processor's secure page; EBS never sees or stores them.

You can replace your card on file at any time from your Billing page. If a charge fails, we'll ask you to update your card; services can stop if the balance isn't paid.

Digital signage

Each screen licence is $99 a year and renews every year until you stop it. We charge your card one month before the licence renews, and we email you about a week before that charge. To stop renewing, remove the licence from your Digital Signage page before the renewal charge. If you contact us after the renewal charge but before the licence actually renews, we'll refund that renewal. Once a new licence year has started, it isn't refundable.

Free trials are one per email address, for 30 days on one screen. If you choose "Keep my screen," we save your card and charge $99 the day before your trial ends, and email you about a week before. You can cancel any time before that charge from your Billing page.

Websites and landing pages

The build price covers designing and setting up the site described in your order (the plan, number of pages, and features). The build, or the down payment if you chose a payment plan, is charged when you order and isn't refundable once design work has started. If we haven't started, we'll refund it in full.

Payment plans are for EBS merchants: a down payment, then ten monthly payments charged automatically. Merchant pricing and the payment plan depend on your in-store card processing staying with EBS. If you move your processing elsewhere before the payments are finished, the remaining balance is due and may be charged to your card on file.

Until the build is paid in full, the design and code of your site remain the property of EBS, and we host them for you. Once it's paid in full, the site's design and your content are yours to keep. Your own content (logos, photos, text you give us) is always yours.

Hosting, domain, and maintenance

Every site needs hosting and its domain: $99 a year, or included in the maintenance plan at $25 a month. Yearly hosting is charged one month before it renews, with an email about a week before. The maintenance plan is month to month and covers hosting, the domain, security, upkeep, and content updates you ask for. You can cancel maintenance at any time; you then move to yearly hosting. If hosting isn't paid, the site may be taken offline after we've told you, and the domain may lapse.

Design services

Design services, such as menu boards, menus, flyers, and graphics, are described in your order, including how many rounds of revisions are included. The price is charged when you order and isn't refundable once work has been delivered.

Deliveries, revisions, and approval

We deliver your work in your EBS dashboard under Projects, where you can preview it and either approve it or ask for changes. We also email you when something is ready.

If you don't approve it or ask for changes within 72 hours of a delivery, it is approved automatically. Approving a delivery, yourself or automatically, means it matches what you ordered. Each order includes the number of revision rounds shown on it; more rounds, or changes to what was ordered, are quoted as new work.

Questions and disputes

If something isn't right, contact us first: call (209) 600-3453 or email team@evident.biz. We answer within one business day and will make it right or refund what these terms say is refundable.

If you dispute a charge with your bank or card company instead, we'll share our records with them: your agreement to these terms, your order, every payment and receipt, the emails we sent you, your sign-ins, the deliveries and approvals in your dashboard, and how the service was used. Services tied to a disputed charge may be paused while the dispute is open.

Changes

We may update these terms. Changes apply to orders and renewals after the update; the version you agreed to stays on record. We'll email you before a change affects anything you're already paying for.

Governing law

These terms are governed by the laws of California. Any dispute will be handled in the courts of Stanislaus County, California.
