Privacy policy

What we collect on evident.biz, why, who sees it, and the choices you have. Written in plain English on purpose.

Who we are

Evident Business Solutions ("EBS", "we", "us") is a merchant services and point-of-sale provider headquartered at 401 Downey Ave, Modesto, CA 95354. This policy covers the website at evident.biz. It does not cover the merchant agreements, card processing, or POS software you may sign up for through our partners, each of which has its own privacy terms that we'll point you to when you apply.

What we collect

Information you give us

  • Contact and business details when you fill out a form: your name, business name, phone, email, address, industry, business type, start date, and how you take payments today (monthly volume, average ticket, current processor).
  • Owner details on the application form: owner name, title, ownership percentage, mobile phone, email, and home address, which card networks and banks require to open a merchant account.
  • Processing statements if you upload one for a free rate review. When you use the instant read on the rate review page, the pages are sent to our AI provider (Anthropic) to pull out the totals and fee lines and returned to your browser; Anthropic does not keep them beyond that processing. When you press the read button, the statement, the details you entered, and the read are sent to us as a review request at the same time, and our team keeps them in our private office systems to prepare your review and follow up with you. We also check the business name and merchant ID on the statement against our own customer records, so that a current customer is routed to their account team instead of a sales review.
  • Anything you type in a notes field, or tell us by phone, text, or email.

We do not ask for Social Security numbers, dates of birth, tax ID numbers, bank account numbers, or copies of ID through this website. Those are collected later through a secure signing process with our processing partner.

Information collected automatically

  • Server logs. Our host records standard request data such as IP address, browser type, pages visited, and the time of the visit.
  • Where a form was sent from. When you fill out a form, we record the IP address it came from, the approximate location of that connection (city, region, and country, as our host estimates it), and your browser's time zone.
  • QR code scans and short links. When someone scans a QR code or clicks a short link (ebsqr.com) that an EBS client made with our tool, our server records the time, the kind of phone (iPhone, Android, or other), the approximate city of the connection, and which website sent the click, if any, then sends them on to the client's page. To estimate how many different people used it, it also keeps a one-way code made from the connection and browser that changes every day and can't be traced back to a person. It sets no cookies and doesn't store the IP address. The client sees the totals.
  • Referral codes. If you open an EBS client's referral link, your browser keeps their referral code for 90 days and adds it to forms you send us, so we know who referred you. We tell the client the business name you gave us and how the referral is going, not your contact details.
  • Accessibility preferences. The accessibility widget in the corner of each page stores your display choices (contrast, text size, and so on) in your browser so they stick between visits.
  • Advertising, only if you allow it. If you accept advertising cookies on the cookie banner, the Meta Pixel loads and tells Meta (Facebook and Instagram) which pages you visit and when you send us a form, so we can measure our ads and show them to businesses likely to need us. When you send a form or pay at checkout with advertising cookies allowed, our server also tells Meta about that event through Meta's Conversions API, along with your email and phone number converted to a one-way code (a hash) first, plus your IP address and browser type. The Meta Pixel never runs on our checkout, merchant application, statement reader, or customer account pages, and nothing you enter as statement, card, or application details is sent to Meta. With advertising cookies allowed, when you send a form or pay at checkout, your browser also gives Google your email and phone number as the same kind of one-way code, attached to that event, so Google Ads can tell us whether one of our ads led to it (Google calls this enhanced conversions). If you decline advertising cookies, or your browser sends a Global Privacy Control signal, none of this happens.

How we use it

  • To respond to you, prepare a rate review, and price and open a merchant account you've asked for.
  • To send you information about your application or account, including by text message if you opted in.
  • To keep the site working, secure, and improving.
  • To meet legal, regulatory, and card-network requirements, including Know Your Customer and anti-fraud rules.
  • To verify business inquiries and prevent fraud. When a form comes in, we use automated tools, including AI, to check that the business details add up: for example, that the address, phone, email domain, and website match a real, operating business, and that the location of the connection is consistent with it. These tools may look up public information about the business on the web. The result is a note for our team; it is not an approval or decline, and a person reviews every application.

Who we share it with

  • Processing and product partners needed to open and run your account, such as our payment processors, Fiserv (Clover), Square, and our business funding partners, only once you've asked us to move forward with them.
  • Service providers that run parts of this site and our business, such as our website host (Netlify, which also receives form submissions), our AI provider for the instant statement read and for checking business inquiries (Anthropic, which processes what we send it and does not use it to train its models), our bot-check provider (Cloudflare Turnstile), our accessibility widget provider (CookieYes), our analytics provider (Google Analytics), and our customer relationship system (Zoho).
  • Advertising partners: Meta Platforms and Google, only if you accept advertising cookies, as described above. Each handles that information under its own terms and privacy policy.
  • Legal and safety reasons, when required by law, a court order, or to prevent fraud or harm.

We do not sell your personal information for money. If you accept advertising cookies, sending page visits and form events to Meta, and hashed contact details to Google with form events, for advertising counts as “sharing” under California law, and you can opt out at any time (see Your choices and rights). We do not share your information with anyone else for their own marketing.

Text messages

If you check the text-message box on a form, you agree to receive texts from EBS about your application, account, and service. Message frequency varies and message and data rates may apply. Reply STOP to any message to opt out, or HELP for help. Consent to texts is not a condition of doing business with us. The full text message terms are on their own page.

Cookies and similar tools

When you first visit, a cookie banner lets you accept, decline, or choose which cookies we use, and you can change that choice any time from the banner's settings button. This site uses the accessibility widget's stored preferences, the session data our host uses to serve pages, Cloudflare Turnstile (a spam check on the rate review form), the text-us widget on our support page, Google Analytics, and, only if you accept advertising cookies, the Meta Pixel. Google Analytics sets cookies to tell us which pages people visit, how they got here, and which buttons and forms get used, so we can see what's working. It doesn't tell us who you are. We also use it to see which of our Google ads led to a form or a purchase, and we don't use it to build advertising profiles. The Meta Pixel sets its own cookies (such as _fbp) so Meta can connect a visit to an ad. The team video on our community and about pages comes from YouTube (Google). It loads only when you press play, in YouTube's privacy-enhanced mode, and once it plays YouTube's own privacy policy applies. You can clear these cookies at any time in your browser settings, block them with a browser extension such as Google's Analytics opt-out add-on, or turn on Global Privacy Control in your browser. Turning cookies off may reset your accessibility choices.

How long we keep it

Form submissions and statements are kept as long as needed to respond to you and, if you become a customer, for the life of the account plus the period our partners and regulators require. If you ask for a rate review and don't move forward, we delete uploaded statements within a reasonable period after the review.

Security

The site is served over HTTPS. Form submissions are stored with our host and accessible only to EBS staff who need them. No method of transmission or storage is perfect, so please don't send us Social Security numbers, card numbers, or bank details by email or through a form. We'll always give you a secure way to provide those.

Your choices and rights

Do Not Sell or Share My Personal Information. To stop sharing with Meta and Google for advertising, decline advertising cookies: We also honor Global Privacy Control: if your browser sends that signal, advertising cookies stay off. You can also call (209) 600-3453 and ask us to opt you out.

You can ask us what personal information we hold about you, ask us to correct or delete it, or opt out of marketing at any time. California residents have additional rights under the California Consumer Privacy Act, including the right to know, delete, correct, and not be discriminated against for exercising those rights. To make a request, call (209) 600-3453 or write to us at the address above. We'll verify the request before acting on it.

Children

This site is for businesses and is not directed at children under 16. We do not knowingly collect their information.

Links to other sites

We link to partners, news articles, maps, and social media. Their sites have their own privacy practices, which we don't control.
